What is a Modification?

A modification is a change to a court order. In family law, modifications are most commonly made to child custody, visitation, and support orders. However, modifications can also be made to other family law orders, such as those related to divorce and property division.

Modifications can be made by agreement of the parties or by court order. If both parties agree to the modification, they can submit the proposed changes to the court for approval. If the parties do not agree, the party seeking the modification must file a motion with the court. The court will then hold a hearing to determine whether the modification is appropriate.

“The Best Lawyer for a time in your life when you need the truth!”
I had a nasty divorce going with my ex-wife who was using one of the High Power Dallas Lawyers that was intent on making things difficult and costing both of us most of the money we were fighting over. Duane was able to calm me down and came up with an idea for the settlement that not only saved me and the ex money, but actually made his fees LESS EXPENSIVE!!! You will not hear of that many times with any lawyer. I would recommend him for a simple divorce or a complex one with all of the circumstances that always make things difficult. He just has a way of working things out with all parties that make so much sense the case gets settled and everyone gets what they want.

“Need a good, trustworthy and dependable lawyer? Well Duane Coker is your man!”
I have only been through a divorce once in my life and I thought I would hire a "big name" lawfirm in Dallas to handle my case. Well long story short, all the "big name" lawfirm did was rake me over the coals for money then dropped me like a bad habit after they sucked me dry! I immediately started looking for another lawyer locally in the Denton area and was referred to Duane Coker. I was reffered to Duane by another lawyer that doesn't specialize in divore or family law and was told he would treat me right. Well they were right! He made me feel very comfortable and told the the honest truth about things. He saw what my previous lawyer did to me and what my wife's attorney was doing to me. I am so glad he took my case and got my divorce finalized! He was very up front with things and kept me in loop on everything. The only regret I have is I should have used Duane from the begining! It would of had saved me thousands of dollars and a lot less headaches. I can't say enough good things about Duane and his staff. What a "true" lifesaver they were to me!
    - Kelly
“Honest, trustworthy, sympathetic, above and beyond”
Ms. Robb reviewed multiple documents of my case before the consultation and analyzed the case reasonably and honestly. She is knowledgeable, sympathetic, and shows strong ethic. She even sent me an email to summarize our consultation before signing the hiring agreement. I am so thankful to her for doing above and beyond. Waiting to see the progress.

    - Virginia
    “The best of the best!”
I can't say enough good things about Shelby. He is thorough, bright, diligent, and all-around excellent at what he does. Not only is he extremely knowledgeable in his field, but he is also kind and sympathetic. He listened to my concerns and hopes for the future while also considering the facts and fighting hard with my best interest in mind. I appreciated that he even followed-up with me after everything was said and done just to make sure I was settling into my new normal. I will recommend Shelby to anyone who may find themselves in this tough position. He helped me every step of the way.

Modification of Child Custody & Visitation in Fort Worth

Child custody and visitation orders can be modified if the court finds that the modification is in the best interest of the child and that there has been a material and substantial change in circumstances since the order was last modified or entered. A material and substantial change in circumstances is a change that affects the child’s well-being. For example, if one parent has developed a drug problem, the court may find that this is a material and substantial change in circumstances that warrants a modification of the custody or visitation order.

When determining whether a modification is in the best interest of the child, the court will consider a number of factors, including:

  • The child’s wishes
  • The child’s current and future needs
  • The child’s relationship with each parent
  • The child’s adjustment to home, school, and community
  • The mental and physical health of all parties
  • Any history of abuse

It is important to note that, in Texas, a child custody order cannot be modified within the first year after it was entered, unless the child’s current environment poses a serious question concerning the child’s physical health or emotional development.

Modification of Child Support in Fort Worth

Child support orders can be modified if the court finds that the modification is in the best interest of the child and that the circumstances of the child or a person affected by the order have materially and substantially changed since the order was last modified or entered. A material and substantial change in circumstances is a change that affects the child’s needs or the ability of the parents to provide for the child’s needs. For example, if the child has developed a serious medical condition, the court may find that this is a material and substantial change in circumstances that warrants a modification of the child support order.

When determining whether a modification is in the best interest of the child, the court will consider a number of factors, including:

  • The child’s current and future needs
  • The child’s age and abilities
  • The child’s financial resources
  • The child’s physical and emotional health
  • Each parent’s ability to contribute to the child’s support
  • Any financial resources available for the child’s support
  • The child’s educational needs
  • The child’s need for support, including medical support
  • Any other relevant factor

It is important to note that, in Texas, a child support order cannot be modified if it has been less than three years since the order was last modified or entered and the monthly amount of the child support order differs by either 20% or $100 from the amount that would be awarded in accordance with the child support guidelines.
